A contest visible from a banner on Facebook that promises to win up to 300 euros worth of H&M clothing , uses the brand's image without its consent and constitutes fraud to obtain downloads from customers' mobile phones, according to a statement from Facua .

“You have the chance to win a 300€ H&M gift band data voucher” is the claim that takes users to a MyBip.com domain that encourages them to enter their mobile number to participate in the competition, which will result in SMS being sent at a cost to the company. Similar campaigns have been carried out with gift vouchers from Zara, which does not carry out any form of advertising.

Messages cost 0.35 cents and users must remain subscribed for at least 30 days to be able to participate, which is why the consumer association has sued the company, which had already been the subject of investigations for a fraudulent intelligence test seeking the same objective.
